Overview of India’s Public Procurement System

The public procurement system of India is intended to ensure transparency, fairness, and efficiency in the procurements of goods and services by government departments, ministries, and public sector enterprises. It has various platforms for tender requests and procurement, all aimed at ease of business and submitting tenders.

Central Public Procurement Portal (CPPP)

The CPPP acts as the primary portal for central ministries and various public sector undertakings to issue tenders. Being the most popular portal for tendering, it provides an exhaustive list of government tenders.

Government e-Marketplace (GeM)

The GeM platform was developed by the Ministry of Commerce and Industry to allow government agencies to procure goods and services within one marketplace.

GeM is an easy-to-use platform that allows businesses, particularly MSMEs, access to tenders for products and services they purchase commonly. GeM promotes transparency, and they help facilitate procurement.

State-Based Procurement Portals

While GeM is a central government platform, individual states have their own portals, where those portals handle the tenders for state government departments and public sector undertakings.

Types of Government Tenders

There are different types of government tenders, and government tenders can be issued in different formats depending upon the procurement requirements. It is important that businesses understand the different types of tenders if they are to pursue opportunities in government procurement.

1. Open Tenders

Open tenders are the most common type of government tenders. These tenders are advertised publicly, and all eligible suppliers can submit a bid. Open tenders encourage transparency, and competition by allowing all suppliers to compete.

2. Limited Tenders

Limited tenders are issued when only a limited number of suppliers are invited to bid upon the tender. These are typically issued for specialized or urgent procurements, where the government is looking for a specific product, and/or expertise.

3. Single Tenders

Single tenders are issued where the only supplier that can meet the requirements of the government is one supplier in particular. A single tender is usually used in highly specialized and/or urgent cases.

4. Global Tenders

The government can issue global tenders when the government is seeking suppliers from around the world. Global tenders are invitations to international businesses, and are typically issued when there is no capable or eligible Canadian domestic supplier.

Key Eligibility Criteria for Government Tenders

In order to be eligible to submit a tender for a government contract, a business must meet certain eligibility requirements. The eligibility criteria will vary depending on the type of tender and the specifications laid out by the tendering authority.

GST Registration: It is expected that all businesses are registered under GST for participating in government procurements.

A PAN card: businesses must also obtain a valid PAN card from the tax authorities.

Company Registration: Proof of company registration, in order to demonstrate that the business is registered and legally recognized.

MSME Registration: MSMEs have special provisions and relaxed requirements in the tendering process such as a reserved quota and a general relaxation of some financial criteria.
